On his way out the door, Joe Biden is endorsing term limits for Supreme Court Justices. Biden is vague about the details. He doesn’t say whether the limits would apply to current Justices. Clearly, though, that’s what he has in mind because his beef is with the current Republican-appointed Justices. They are the ones he wants sidelined.

Sen. Sheldon (“Whites only”) Whitehouse is explicit about sidelining them. He and some Senate colleagues are sponsoring legislation that would enable the president to nominate a new Justice every two years. That Justice would replace the most senior current one, who would be demoted to a role under which he could participate in only a small number of cases. Clarence Thomas, John Roberts, and Samuel Alito would be the first three so sidelined.
