Last night, in my “instant analysis” of Alvin Bragg’s lawsuit against House Republicans, I noted that the judge assigned to the case, Mary Kay Vyskocil, was nominated by Donald Trump. I suggested that, although some of his nominees have ruled against Trump and although Judge Vyskocil does not seem like a GOP partisan, there was reason to believe she would not be hostile to the former president’s interests.
However, a reader informs me that Vyskocil was first nominated by Barack Obama. Trump renominated her as part of a deal with Sens. Schumer and Gillibrand. Under this deal, our reader believes, Trump got two of his New York judgeship picks confirmed and Schumer/Gillibrand got one — namely Vyskocil.
Thus, Vyskocil was not really a Trump selection. This doesn’t mean she won’t play it straight in this litigation. However, because she’s an Obama/Schumer/Gillibrand pick, we shouldn’t be too confident that she will.
UPDATE: For a contrary view of Judge Vyskocil and her nomination, see this subsequent post which is based on an email I received from another reader.
The judiciary, at all levels, is corrupt. The reason is because "judgement" is a divine function ("judge not, lest thee be judged"), and judges are humans.
Do we need judges? I don't think so. They usually make defective judgements and thereby introduce injustice into the justice system.
So who referees the justice system? How do we make judges follow the law?
Do away with lifetime appointments. Make judges answerable to We the People, not by electing them, but by making it easier to remove them.
